Attorney Thomas C. Willcox has filed a class action in New York Supreme Court on behalf of a proposed nationwide class of consumers who purchased products, services, or programs from The 7th Witch House or The Order of Dark Arts since January 1, 2018.
The suit names six plaintiffs, Sarah Dietzschold, Sandra Hubbard, Idelisa Cintron, Megan McCullough, Jocelynn Carothers, and Brianne Bishop, along with additional plaintiffs who are not publicly identified due to documented safety and retaliation concerns. Defendants are Ashley Castro (also known as Ashley Mattern and Ashley Otori), Rin Otori, Georgelina Pena, and the businesses they operated as The 7th Witch House and The Order of Dark Arts.
The complaint alleges consumer fraud, misleading representations, undelivered products and services, and retaliation against former community members who raised concerns or left the organizations.
The lawsuit alleges conduct that may have affected customers or members in several ways. The following summarizes the principal allegations at issue.
The complaint alleges that Defendants falsely represented that they had a partnership with Swarovski and marketed products using the Swarovski name and branding. It further alleges that Defendants falsely claimed that Ashley Otori would be designing an upcoming Audemars Piguet Royal Oak watch.
The complaint alleges that Ashley Otori falsely represented that she was enrolled in and graduated from a Harvard PhD program in clinical psychology in approximately 2 years, publicly described herself as a doctor, and claimed to hold a Texas psychology license.
The complaint alleges that Defendants marketed occult and spiritual products and services as capable of producing specific health, medical, psychological, financial, and other real-world outcomes without scientific or clinical substantiation. It further alleges that consumers paid for products, pre-orders, courses, and educational materials that were incomplete, substantially delayed, or never delivered as promised, without refunds or meaningful remediation.
The complaint alleges a sustained pattern of retaliation against Plaintiffs and other former community members who raised concerns, left the organization, or asserted their legal rights, including doxxing, public disclosure of personal information, coordinated online harassment, threats, impersonation, interference with professional relationships, and malicious or baseless reports to child-welfare and other authorities.
The complaint asserts claims under consumer-protection statutes in Virginia, Georgia, and Ontario, as well as claims under New York General Business Law.
The complaint also asserts claims for breach of contract, unjust enrichment, intentional infliction of emotional distress, libel, and a permanent injunction barring further retaliatory conduct.
The lawsuit seeks class certification on behalf of all proposed class members and damages and other relief available under applicable law.
